1. About the service
Mieszk.pl is an online service that analyzes apartment-sale listings from Otodom.pl and generates a report with price, location, condition and summary assessments. Owner and operator: Yuliya Chepikava (sole proprietorship registered in Poland), Tax ID (NIP) 1182241803, REGON 522029471, mailing address: ul. Williama Szekspira 4, 01-913 Warsaw, Poland. Contact: support@mieszk.pl.
2. Acceptance
By using the service (including free analysis) you confirm you have read, understood and accept these Terms. If you don't agree, stop using the service.
The service is available to persons aged 18+ with full legal capacity.
3. User obligations
- Use the service only with URLs of listings publicly posted on Otodom.pl.
- Don't try to bypass the rate limit, don't make automated requests, don't scrape our API.
- Don't use the service for illegal purposes, don't resell our reports to third parties without our written consent, don't build derivative databases.
- Reports are intended for personal use in your home-purchase decision. Commercial use (agencies and brokers) is possible only by separate agreement.
4. Free access and payments
- The report is prepared for a specific listing and includes: a price assessment against the nearest transactions from the RCN registry (notarial-deed prices, not asking prices), AI photo analysis of condition, location with a precise commute to Centrum, a full purchase-cost calculation, and an overall score with a detailed summary.
- Reports are free. A free account (email address) is required; no payment card is needed.
- Fair use: the service is intended for your own home search. To protect it from automation and abuse, a limit of about 30 reports per day per account applies — it does not restrict normal use.
- Previously purchased paid options (one-time unlocks, the pass subscription): one-time credits never expire; the pass subscription can be cancelled at any time — access lasts until the end of the paid period. The payment, refund and complaint provisions (sections 5–7) apply to such purchases; payments were handled by Stripe, prices were final in PLN (the seller is exempt from VAT), and a receipt was sent to the email provided at payment.
5. Right of withdrawal (14 days)
Under the Polish Consumer Rights Act (art. 27), a consumer may withdraw from a distance contract within 14 days without giving reasons.
Exception: under art. 38 point 13 of the same Act, the right of withdrawal does NOT apply to digital content delivered before the 14-day period, provided the consumer expressly consents and acknowledges loss of the withdrawal right.
When paying for the extended analysis you expressly consent to immediate delivery of digital content (the report) and acknowledge loss of the 14-day withdrawal right after delivery. This is accepted by clicking "Pay" on the checkout page.
6. Refunds
Separately from the cases below, a voluntary 7-day satisfaction guarantee applies — if a paid Pro report didn't help, you can request a refund within 7 days (see our Refund policy). This section covers statutory and defect-based refunds.
We refund 100% in these cases:
- A technical failure that prevented the report from being delivered.
- Duplicate charges caused by a payment-system error.
- The report contains factual errors (wrong price, area or address) that make it unusable.
Send refund requests to support@mieszk.pl within 30 days of payment. We review within 7 business days; refunds land within 14 business days after approval.
Outside the voluntary guarantee above, we don't refund a delivered report based on subjective dissatisfaction (e.g. the "worth considering" verdict felt too soft). The report is analysis, not a guarantee.
6a. Complaints (digital-content conformity)
Independently of the refund policy (section 6), you have the right to file a complaint (reklamacja) under art. 43h-43q of the Polish Consumer Rights Act — the digital-content conformity regime in force since January 2023.
What counts as grounds: a report not delivered after payment, a report with factual errors (wrong price, area, address), or paid-tier features not working as described.
How to file: email support@mieszk.pl with a description of the issue, the link to the report, and the purchase date. You may also use the statutory complaint-form template.
Response time: we reply within 14 days of receiving the complaint. Failure to respond within that period means the complaint is deemed accepted (art. 7a of the Consumer Rights Act).
Remedies: first, we restore conformity (e.g. regenerate the report, deliver the missing section). If that is impossible or disproportionate, we reduce the price or refund in full. You have the right to terminate the contract if the non-conformity is material.
7. Disclaimer
Mieszk.pl is an informational service — not a realtor, appraiser or financial advisor. Our report aggregates public data + AI interpretation, intended as a tool for your own analysis.
The service does not provide advisory services and does not recommend investment decisions — it delivers information and analyses only. The report is informational; the buy, pricing and negotiation decisions are yours alone.
AI-generated content. The description translation, photo analysis, summaries and final verdict are generated or assisted by artificial-intelligence models (incl. OpenAI). In line with art. 50 of the EU AI Act (Regulation 2024/1689) we clearly inform you that parts of the report are AI-generated content and may contain errors. Always verify key facts with the source.
- We don't guarantee the accuracy or completeness of data from Otodom, Cenogram, OSM, Google Maps or other sources.
- The mortgage-approval estimate is a heuristic based on KNF Rekomendacja S. The actual decision depends on credit history (BIK), employment, age and other factors we don't check.
- The AI verdict (great_deal / worth_considering / caution) is not investment advice. You make the buying decision through your own due diligence.
- Before buying: inspect in person, check the land register (EKW), consult a mortgage broker and a lawyer.
8. Limitation of liability
To the maximum extent permitted by law, we are not liable for:
- Purchase decisions made based on our reports.
- Financial losses, lost profits or reputational damage.
- Service outages caused by third-party providers (Otodom, OpenAI, Cloudflare, etc.).
- Otodom changes that break our parser (we fix quickly but don't guarantee 100% uptime).
Our maximum liability to any given user is capped at what that user paid us in the preceding 12 months.
The cap does not apply to willful misconduct, gross negligence or other cases expressly required by Polish law.
9. Intellectual property
- The design, code, copy, prompts and algorithms are the operator's intellectual property.
- You receive a non-transferable, non-exclusive license to use a specific report for personal purposes.
- Listing content (descriptions, photos) belongs to the authors / sellers. We only analyze publicly available information.
10. Violations and blocks
We may block access (including IP rate-limiting) on detection of automated requests, attempts to bypass limits, API reverse-engineering, report scraping or other abuse. This doesn't affect the refund rights in section 6.
11. Terms changes
We may update these Terms. The current version is available on this page with the last-updated date at the top. Paid users are notified by email of changes affecting paid services.
12. Governing law and jurisdiction
These Terms are governed by the law of the Republic of Poland. All disputes are resolved by Polish courts at the operator's registered seat, unless mandatory consumer-protection provisions say otherwise.
Consumers may also use out-of-court dispute resolution via the Polish Trade Inspection (Wojewódzki Inspektorat Inspekcji Handlowej) or the konsument.gov.plportal. The EU Commission's ODR platform was shut down on 20 July 2025.
13. Contacts
Questions, refund requests, complaints, personal data matters: support@mieszk.pl
See also Privacy policy.
The address support@mieszk.pl also serves as the single point of contact for users and authorities under art. 11 and 12 of the EU Digital Services Act (Regulation 2022/2065 — DSA). Accepted languages: Polish, English, Russian.
14. Accessibility (EAA)
The European Accessibility Act (Directive 2019/882, implemented in Poland by the Act of 26 April 2024 on ensuring accessibility requirements) entered into force on 28 June 2025.
Mieszk.pl is operated by a sole proprietorship that qualifies as a micro-enterprise under art. 7(1)(1) of the Polish Entrepreneurs' Law (fewer than 10 employees, annual turnover not exceeding €2 million). Under art. 4(5) of Directive 2019/882 and art. 4(3) of the Polish implementing act, micro-enterprises are exempt from EAA service obligations.
Despite the exemption, we aim for WCAG 2.1 AA compliance where feasible. If you encounter an accessibility barrier, please email support@mieszk.pl and we'll do our best to fix it.
